Terms of Service

These terms are the agreement between you and [operator's legal name: to be added], who runs Devotions ("we", "us"). They apply when you visit Devotions, pay on it, sign in, or run a creator page. Our contact details are at the end of this page and on the Contact page.

Our Refunds and cancellations policy, Privacy Policy and Cookies page are part of these terms.

The short version

• You must be 18 or over to use Devotions.
• When you pay on Devotions, you pay us. Stripe processes the payment, the creator gets the amount shown for them, and we keep a service fee. Every price we show includes that fee.
• A game is a capped, randomised tribute amount. It decides how much you pay the creator, and never more than the maximum you see before you pay. You never get money or anything else back from a game.
• A tribute is a voluntary gift. You get nothing in return.
• Whenever we refund a payment, we refund the service fee on it too.
• Anyone can report a page or complain to us, and creators can appeal our decisions.

Who can use Devotions

• You must be 18 or over and able to make a legally binding contract where you live.
• You confirm your age when you set up an account and every time you pay. If you pay as a guest, you confirm it at checkout.
• If we find that an account belongs to someone under 18, we close it and may refund their payments.

Accounts

• You sign in with Google. We don't have passwords.
• You don't need an account to pay a creator. You can always pay as a guest.
• The first time you sign in, you choose how you'll use Devotions: as a supporter, who pays creators and can choose to appear on their leaderboards, or as a creator, who runs a page.
• Keep your Google account secure. You're responsible for what happens under your account, unless it happens because of something we did wrong.
• You can ask us to delete your account at any time by emailing [support email address: to be added]. We keep payment records for as long as the law requires. The Privacy Policy explains what we keep and why.

What Devotions is

Devotions gives creators a public page with their links, tributes, games and leaderboard, and overlays for their stream.

• Tributes are one-off voluntary payments to a creator.
• Games (wheels, dice and cards) are capped, randomised tribute amounts. You pay an entry, the game decides how much more you pay the creator, and the total never goes above the maximum shown before you pay.

Who you're paying

When you pay on Devotions, you make the payment to us, [operator's legal name: to be added]. We take it through Stripe in our name, and our name appears on your card statement. When you pay, Stripe automatically sends the creator's share to the creator's own Stripe account and our service fee to us. We don't hold the creator's share in our own bank account.

Because you pay us, we're responsible to you for the payment and for running the game: we run every game on our servers, we charge your card, and we handle refunds and disputes. The creator is responsible for their own page and for anything they say or promise you, on or off Devotions.

Prices and the service fee

• Creators set their prices. The person paying also pays our service fee. Every price we show includes the fee, and the checkout page shows how much goes to the creator and how much is our fee.
• Our standard service fee is 20% on games and 25% on tributes, with a minimum of £0.50, $0.50 or €0.50 per charge. We may agree a different fee with a creator. The price you see before you pay always includes the exact fee.
• Prices are in the creator's currency: pounds, US dollars or euros. If your card is in another currency, your bank may charge you for converting it.
• The price you see is the total you pay. No tax or other charge is added at checkout.
• Stripe emails you a receipt for each charge, and we email you a confirmation of what you bought, what you agreed to and your right to cancel.

Tributes

• A tribute is a voluntary gift to a creator. You get nothing in return: no content, service or promise.
• Your name and message, if you add them, go only to the creator. The public sees only what the leaderboard rules allow.
• Tributes are refunded only in the cases our Refunds policy lists, such as a mistake or a payment you didn't make.

Games

Before you pay

The game page shows you, before you pay:

• the entry price and the number of plays,
• how the game decides the amount, and every possible outcome with its chance,
• the most the whole run can cost you, including every fee.

To start, you confirm that you're 18 or over, that you want your run to start now and that you lose your 14-day right to cancel once it starts, and that you agree to these terms. Then you press Pay now.

How a run works

1. At checkout you pay the entry and its service fee. Stripe saves your card so that we can take the end-of-run charge.
2. If the creator is live when you pay, your run joins their queue and the creator plays it on stream when your turn comes. The Twitch username you gave is shown on stream, unless the creator hides names.
3. If the creator isn't live when you pay, you play your run yourself on your run page, in the browser you paid in. Keep that browser. If you lose access, email us.
4. Each play adds an amount, or changes later plays, as the outcome shown for it says. The total never goes above the maximum.
5. When your run ends, we charge what it added, plus the service fee on that amount, to the same card in one charge. If the run added nothing, we charge nothing more.

What a game is not

Games are not gambling or a lottery. Whatever the result, you never get money, credit, discounts, content or anything else back. A game only decides how much you pay the creator, within the maximum you agreed to.

Fair play

• Your run's results come from a random seed that is fixed before your first play. From checkout, your run page shows a fingerprint (a SHA-256 hash) of that seed. When your run can no longer be played, the page shows the seed itself, so you can check that the results were fixed before you paid.
• Your run always uses the rules you saw when you paid, even if the creator changes the game afterwards.

When your run ends

• Your run ends when you've used all your plays, or when the total reaches the maximum.
• If you stop playing a run you play yourself, it ends at its current total 24 hours after your last play, and we charge that total. You aren't charged for plays you didn't use.
• If the stream ends while the creator is playing your run, the run ends at its current total within 15 minutes of the stream ending, and we charge that total.
• If your turn on stream never comes, you don't pay for it: we refund your entry and its fee automatically, as our Refunds policy explains.
• If you pay for a run you play yourself and don't start it within 30 days, we refund your entry and its fee automatically.

If the end-of-run charge fails

• The amount is still owed, because you agreed to it before your run started.
• If the charge fails for a technical reason, we try again automatically. If your bank declines it, or asks you to approve it, we don't try the card again: your run page shows a link to pay. If the link has expired, the page makes a new one.
• Until you pay, you can't start another run with that creator using the same card, or while signed in to the same account.
• We may email you about it at the address you gave at checkout.

Leaderboards and donation walls

• A creator's page can show a leaderboard of supporters and a wall of recent tributes.
• You appear on a creator's leaderboard only if you're signed in, have confirmed you're 18 or over, have chosen an alias, and have ticked the box for that creator. The box is never ticked for you.
• You can untick it at any time. Your alias then leaves that creator's page and overlays straight away. We can't recall screenshots that other people took earlier.
• We show your alias, your rank and your total for that creator. Never your Google name, photo or email address.
• Totals count payments made through Devotions to that creator, minus refunds. Disputed payments don't count, and neither do payments through payment links.
• Guests, and supporters who haven't ticked the box, appear on the wall only as "Anonymous", with the amount and time.
• A rank brings no reward, discount or perk of any kind.
• Your alias must not be someone else's name or pretend to be someone else.

Payment links

Some creators list other ways to pay them, such as a crypto wallet or payment page, Throne or YouPay. Those payments go straight to the creator through that service. We don't process them, we can't refund them, and they never count on leaderboards. That service's own terms apply.

If you're a creator

Taking payments

• You use Devotions for your own business or trade, not as a consumer.
• To take payments you need a Stripe Express account. Payment processing for creators is provided by Stripe and is subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By taking payments on Devotions, you agree to it. You agree to give us and Stripe accurate information about you and your business, and you allow us to share it, and information about your payments, with Stripe.
• Your Stripe account's currency must be pounds, US dollars or euros. Your prices are in that currency.

Money

• You receive the full amount shown for you on every payment. The person paying pays our service fee on top, and Stripe's processing costs come out of our fee. You can't change the fee.
• We ask Stripe to keep each payment in your Stripe balance for 7 days before it can be paid out, so refunds and chargebacks can come out of it. After that, Stripe pays your balance out to your bank on the schedule shown in your Stripe Express dashboard.
• If we refund a payment made to your page, or the payer's bank reverses it (a chargeback or dispute), your share comes back out of your Stripe balance. If your balance is too low, it can go negative until later payments cover it.
• You can refund a payment made to your page yourself, from Payments, for 6 days after it was made; after that, ask us. We refund the payer in full, including our fee, and your share comes back out of your balance.
• We can pause your payouts through Stripe while we look into a report, a pattern of disputes or suspected fraud on your page. We tell you when we do this and why, unless the law stops us.
• You're responsible for your own taxes.

Your games

• You set each game's entry price, number of plays, maximum and outcomes. New games stay off until you turn them on.
• Describe your games as what they are: capped, randomised tribute amounts. Don't present a game as gambling, a lottery or a way to get something back.
• Don't offer anything, on or off Devotions, that depends on a game's result, a tribute or a leaderboard rank.

Rules for everyone

These rules cover everything you put on Devotions: pages, links, pictures, aliases, names and messages.

• Nothing illegal.
• Nothing that involves or sexualises anyone under 18.
• No pornographic or sexually explicit content: no nudity or sexual acts, and no pictures, video, text or links whose main purpose is sexual arousal.
• Mark links to adult sites as adult content. The 18+ confirmation on a link is a warning to visitors, not an age check.
• No selling or advertising sexual services, drugs, weapons or other regulated goods.
• No threats to expose, shame or harm anyone, even as part of a scene or a game.
• No harassment, hate, or sharing someone's personal information without their permission.
• No pretending to be someone else.
• No gambling, lotteries, raffles or sweepstakes.
• No collecting money to pass on to someone else.
• Don't pay with a card or money that isn't yours. Creators must not encourage anyone to pay with money that isn't theirs, to borrow to pay, or to keep paying after they've said they want to stop.
• No content that infringes someone else's copyright, trade mark or other rights.
• Don't interfere with Devotions: no getting around limits or bans, no automated scraping, no attacks, and no tampering with queues, games or payments.

You keep ownership of what you publish. You give us permission to host it and show it on Devotions and on your overlays for as long as it's published.

Reports, moderation, complaints and appeals

Reporting

• Every creator page has a Report link, and you can report anything on Devotions, including illegal content, at devotions.vercel.app/report or by emailing [support email address: to be added].
• We look at reports as quickly as we can, and deal first with illegal content and anything involving children. If you give us an email address, we tell you when we've dealt with your report.

What we may do

If content or behaviour breaks these terms or the law, we may remove content, hide a page, pause payouts through Stripe, refund payments, or suspend or close an account. Where there's a risk of harm, fraud or illegal content, we can act straight away without warning. We tell you what we did and why, unless the law or someone's safety stops us.

Complaints

You can complain to us about:

• content you think is illegal or breaks these terms,
• how we handled a report,
• anything we did to your content or account,
• anything else about how we run Devotions, including how we meet our online safety duties.

Email [support email address: to be added] with "Complaint" in the subject line. We confirm we've got it within 5 working days and aim to give you our decision within 14 days. If we need longer, we tell you why.

Appeals

If we remove your content or restrict or close your account, you can appeal within 30 days by emailing [support email address: to be added] with "Appeal" in the subject line. Where we can, someone who wasn't involved in the first decision reviews it. If we got it wrong, we put your content or account back.

Ofcom regulates online safety in the UK. It doesn't decide individual complaints, but you can tell it about a service that you think isn't keeping people safe.

Closing accounts

• You can stop using Devotions at any time.
• We can suspend or close an account that breaks these terms, puts others at risk, puts our payment processing at risk, or when the law requires it.
• If we close a creator's account, we refund runs on their page that haven't started. Runs already being played end at their current total.

Our responsibility to you

If you're paying a creator

• If we break these terms or don't use reasonable care and skill, we're responsible for loss you suffer that was a foreseeable result. We aren't responsible for loss that wasn't foreseeable.
• Nothing in these terms takes away your legal rights as a consumer.
• We never limit what we owe you for a payment that was faulty or charged wrongly to less than what you paid for it: the entry, the end-of-run charge and the service fee.
• We never exclude or limit our responsibility for death or personal injury caused by our negligence, or for fraud.
• We aren't responsible for what a creator says, does or promises outside our service, or for delays caused by events outside our reasonable control. If a fault stops a game, we refund as our Refunds policy explains.

If you're a creator

• We aren't responsible for loss of profit, revenue, business or goodwill, or for indirect loss.
• Otherwise, our total responsibility to you for everything in any 12 months is limited to the larger of £100 (or the same amount in your currency) and the service fees we earned from payments to your page in the 12 months before the event that caused the claim.
• These limits don't apply to death or personal injury caused by our negligence, to fraud, or to anything else the law doesn't allow us to limit.

Changes to Devotions and to these terms

• We keep improving Devotions, so features can change.
• When we change these terms, we publish the new version here with a new version number on the day it takes effect. A payment is covered by the version you agreed to when you made it, and we keep every earlier version: ask us and we send you the one that applies.
• We email creators at least 14 days before a change that affects them takes effect, unless the law or a safety issue needs a faster change. If you don't agree, you can close your account before then.

Law and courts

The law of England and Wales applies to these terms. If you're a consumer living in Scotland or Northern Ireland, you can also bring a claim in your local courts. If you live elsewhere, you keep the protections your local law gives you that a contract can't take away.
